    Florida Federal Court Grants DISH/NagraStar Final Judgment against Douglas Rosen, Issues Permanent Injunctive and Impoundment Relief, and Seizes the Fixdish.com domain

    On August 25, 2014 the United States District Court for the Southern District of Florida granted DISH Network and NagraStar’s motion for final judgment against Broward county resident Douglas Rosen. Rosen was sued by DISH Network and NagraStar for violations of the Digital Millennium Copyright Act and other federal statutes for claims arising out of his operation of the website www.fixdish.com and his trafficking in various circumvention devices and services. The Court’s order imposes statutory damages against Rosen in the amount of $126,500.00. Last month the Court granted DISH Network and NagraStar’s motion for permanent injunctive relief against Rosen and issued an order prohibiting him from future violations subject to the penalty of contempt. The Court also ordered the impoundment of all circumvention products and technology remaining in the possession of Rosen and Ordered the transfer of the fixdish.com website to the custody of NagraStar.

    DISH Network and NagraStar continue to investigate and take action against those responsible for trying to circumvent the companies’ security system in order to gain unauthorized access to DISH Network programming.
