Today the Danish Supreme Court upheld a decision from the High Court and District Court stating that the owner of www.popcorntime.dk is liable for contributory infringements to Popcorn Time.
The owner has been sentenced for guiding users on how to download and use Popcorn Time, as well as guiding on how to use VPN-services to hide from authorities.
For this he has been sentenced conditional imprisonment of 6 months, 120 hours community services and confiscation of more than DKK 500,000 which he made in revenues from advertisement on the website.
The judgment is one the first in the world, if not the first, on the legal basis of criminal contributory copyright infringements. It thus confirms that marketing and recommendations on websites are in fact contributory infringements even though they are not related to any particular copyright infringement, but rather to the infringements related to the Popcorn Time service in general.
